Notification fixing approval time for CLR and Inter state

The Labour, skill and Employment Department, Govt. of Gujarat has come out with a notification fixing maximum period in which a registration/licence application has to be approved under The Contract labour (R & A) act and Interstate Migrant Workmen Act. Accordingly any such application pending beyond 45 days from the date of its application will be deemed as approved. Necessary notification is attached.

The Hon. Supreme Court has through its Judgement in SLP No. 811/2021 dated 08.03.2021 ruled that Conveyance Allowance is NOT WAGES as defined in section 2 (22) of The ESI Act. Relevant judgement along with ESI department’s circular is attached.

Important changes in The Contract Labour (R & A) Gujarat Rules, 1972

The Labour and Employment Department, Government of Gujarat has published one notification dated 14/06/2021 making some important changes in The Contract Labour (R & A) Gujarat Rules, 1972. The same are as follows:-

  1. The practice of filing half yearly return by contractors (Form xxiv) is done away with. The form stands deleted.
  2. Filing of annual return (Form xxv) by employers is discontinued. The form stands deleted.
  3. Displaying abstract of Contract Labour Act by contractors is discontinued. Rule 79 stands deleted.
  4. Every Principal Employer, Contractor, establishment will have to file Consolidated Annual Return (CAR) between 1st January and 1st March each year.

ESI Corporation declares special relief to dependants of deceased insured person in the event of death due to Covid-19

1. The scheme is valid from 24/3/2020 to 22/3/2022 (2 years).
2. IP (Insured Person) should be registered at least three months prior to being detected as Covid positive.
3. IP (Insured Person) should be in employment as on date of on becoming Covid positive and minimum 70 days contribution in last one year should have been remitted.
4. Wife (Spouse) will get 3/5th of full rate (90% of average daily wages) for life. For eg: If average daily wages is 100 then full rate will be (100*90%) = 90 and 3/5th will be 90*3/5=60
5. Children (Son & unmarried daughter) up to 25 years will get 2/5th of full rate.
6. Widow mother will get 2/5th of full rate.
7. Total relief will not exceed full rate if all are eligible.
8. If none of the above are eligible than any parent at the rate of 3/10th of full rate and to any dependant at the rate of 2/10th of full rate.
9. Minimum relief amount will be ₹1800/- per month.
10. Claims will be extended even when death occurs after testing covid negative.
11. Claim will be settled in 15 days.
12. Claim has to be filed in form CRS-1
